Costs (effective from October 29, 2002)

The cost of your Website starts from USD195 (U.S. dollars). The final price depends on the number of pages and forms, support for additional browsers and other options. Look for discounts below.

You'll receive:

Original initial design concept (layout, graphics, navigation structure) of the Website, a picture in JPEG or GIF format
Custom graphics developed exclusively for you (except for the logo)
Final HTML realization of your Website
Special menu, if ordered
Testing and optimization for the Internet Explorer and optionally (if ordered) for other browsers
TITLE and META tags to achieve better ranking on search engines, if promotion ordered
Uploading of your Website to the hosting server

Turnaround Time

We offer two types of development turnaround time: Normal and Urgent.

In the Normal mode, the initial design concept is developed and sent to you, the Customer, in 7 calendar days. This is the amount of time required to thoroughly research your business and understand all its details before we create your unique design. We may contact you by e-mail for additional details and discussion.

In the Urgent mode (+50% "rush" charge applied) you'll receive the initial design concept in 5 working days.

The time for creation of your initial design concept - plus additional time needed for implementation of your approved design into HTML (cut up the concept, insert your images and text) - will make up the total time to complete your project (up to 21 calendar days).

In case you have a database driven Website the total time to complete your project is 30-60 calendar days. The exact period can be found in the specification for your project.

The number of alterations you desire - plus additional time needed for implementation of your approved design - will make up the total time to complete your project. Each alteration usually requires up to 48 hours in the Normal case - and up to 24 hours in Urgent cases - after we receive your input to our project inquiries.

Communication and Delivery

All communication about - and delivery of - completed work will be conducted by e-mail. You agree to confirm receipt of all e-mails from us by sending our company a "receipt" e-mail. This ensures that there is a virtual "paper trail" documenting our communications throughout the process. The completed work will be delivered to you via e-mail.

Payments

We accept payments by:

credit card (Visa, MasterCard, Discover, AmEx, Dinners Club);
wire transfer.

The Development Process

You have to make $195 pre-payment to start the design of the initial design concept. Development of your Website begins only when the pre-payment is received. Once you approve the Concept and pay remaining amounts, we'll do HTML realization and send you the final package or upload the complete Website to your hosting server.

Additional Quotes

In some cases we retain the right to issue an additional quote after receiving payment for a logo; i.e. when you request other custom features which are not part of the stated project plan. You'll be advised if this is relevant to your project, and then have the option of accepting or rejecting this additional expense.

No Liability

In no event Elington LLC will be liable for suitability, merchantability, or usability of products and services developed and delivered.

Copyright

Final products developed by Elington LLC are the sole property of the Customer once payment has been made in full. However, the initial concepts remain our property. We have the right to place products developed on the portfolio page of our Website.

Termination and "On Hold" Policies

You can ask us to put a design "on hold" at any time, then resume its development within two months of your payment. If the client halts work or applies by registered letter for a refund, 50% will be deducted from the initial payment, the balance of which shall be returned to the client in 3 business days after receiving the letter.

Miscellaneous

These Terms of Service are the complete Agreement between Elington LLC (WebSite Interactive�) and the Customer. This Agreement supersedes all prior agreements or promises made by Elington LLC's representatives that differ in any way from these Terms and Conditions.

Any modifications of this Agreement must be in writing signed by the party or parties to be bound by modifications.

Any notices required under this Agreement must be delivered in person, mailed (properly addressed and with postage prepaid), faxed or e-mailed to the party entitled to receive the notice.

The Customer agrees that it shall defend, indemnify, save and hold Elington LLC harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against Elington LLC, its agents, Customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by the Customer, its agents, employees or assigns.

The Customer agrees to defend, indemnify and hold harmless Elington LLC against liabilities arising out of:

(1) any injury to person or property caused by any products sold or otherwise distributed in connection with Elington LLC;

(2) any material supplied by Customer infringing or allegedly infringing on the proprietary rights of a third party and (3) copyright infringement.

The Customer agrees to limit the liability of Elington LLC to the amount paid for service. This Agreement shall be interpreted under the laws of the USA. Venue for litigating any dispute under this Agreement shall be in the appropriate court in Washington, D.C., USA.
